IMPORTANT NOTICE: THESE TERMS OF SERVICE CONTAIN A BINDING ARBITRATION PROVISION AND WAIVER OF JURY TRIALS AND CLASS ACTIONS GOVERNING DISPUTES ARISING FROM USE OF THE SERVICES. IT AFFECTS YOUR LEGAL RIGHTS AS DETAILED IN THE "DISPUTE RESOLUTION, BINDING ARBITRATION & CLASS ACTION WAIVER" SECTION.

Welcome to Travel Smart Travel Fast ("Travel Smart Travel Fast", "we", "our", or "us"). This document explains the terms under which you may use our services, including the www.travelsmarttravelfast.com website, our mobile applications, and other software provided in connection with our services, the content we publish on the websites, video platforms, blogs, and other online resources (collectively, “Content”), and any products or services you obtain through our websites or applications, including travel documents assistance (all of which we collectively refer to as the “Service”).

1Acceptance of Terms

By accessing, browsing, purchasing, or using any services, you agree to be bound by these Terms and our Privacy Policy, Refund Policy, (collectively, the "Agreements").

By using the Service, you represent and warrant that you are of legal age to form a binding contract (or if you are a minor, that you are using the Service with the permission of your parent or legal guardian). If you do not agree to these Terms, do not use the Service. References to "you" or "your" include individuals and, where applicable, entities on whose behalf a user acts (each an "Applicant").

2Nature of Relationship & Authorization

2.1. Independent Contractor Status. Your use of our Service does not create a partnership, joint venture, employment, or franchisee relationship between you and Travel Smart Travel Fast. We are an independent private company and are not affiliated with any government agency, embassy, or consulate.

2.2. Limited Power of Attorney. By purchasing our Service, you expressly appoint and authorize Travel Smart Travel Fast (and its designated employees or agents) to act as your representative and limited agent for the specific purpose of:

  • Processing and submitting your travel document applications to the relevant government authorities.

  • Accepting any government terms and conditions on your behalf as required to complete the application.

  • Receiving communications and the final travel documents on your behalf.

2.3. Modifications to Service. We reserve the right to modify, suspend, or discontinue the Service (or any part thereof) at any time without notice. We will not be liable to you or any third party for any modification, suspension, or discontinuation of the Service, provided that if we discontinue a Service for which you have already paid but not yet received, you will be entitled to a refund in accordance with our Refund Policy.

2.4. No Guarantee of Approval or Timing. You acknowledge and agree that the granting of travel documents, visas, or authorizations is entirely at the sole discretion of the issuing government authority. Travel Smart Travel Fast does not and cannot guarantee that your application will be approved. Furthermore, any processing times provided by us are estimates based on historical data and government guidance; they are not guaranteed delivery dates. We are not responsible for any delays caused by the government, increased demand, system outages, or administrative errors by the issuing authority.

3Language & Communications

3.1. Governing Language. These Terms are drafted in the English language. In the event of any discrepancy between the English version of these Terms and any translation (whether provided by us or by automated software), the English version shall govern and control.

3.2. User Acknowledgement. By using the Service, you represent and warrant that you understand the English language sufficiently to read, understand, and accept these Terms, or that you have used an independent translation tool to do so. You agree that the inability to read English is not a valid basis for voiding this contract or requesting a refund after the Service has been rendered.

3.3. Service Communications. You acknowledge that all official communications regarding your application, including status updates and support responses, may be provided primarily in English. While we may offer assistance in other languages as a courtesy, we do not guarantee the accuracy of non-English communications.

4Limitation of Liability

4.1. Exclusion of damages. To the fullest extent permitted by applicable law, in no event shall Travel Smart Travel Fast, its affiliates, officers,employees, agents, or licensors be liable to you for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:

  • Costs of missed flights, cancelled hotels, or other travel-related expenses;

  • Loss of profits, data, use, goodwill, or other intangible losses;

  • Damages resulting from government actions, denials, or delays;

Whether based on warranty, contract, tort (including negligence), or any other legal theory, even if we have been advised of the possibility of such damages.

4.2. Liability Cap. Our total aggregate liability to you for any claim arising out of or relating to these terms or our services, regardless of the form of the action, is limited to the greater of: (a) the amount paid by you to us for the specific service giving rise to the claim in the three (3) months prior to the action; or (b) one hundred U.S. dollars (USD $100).

4.3. Statute of Limitations. You agree that any cause of action arising out of or related to the service must commence within one (1) year after the cause of action accrues. Otherwise, such cause of action is permanently barred.

4.4. Jurisdictional Limitations. Some jurisdictions do not allow the exclusion of certain warranties or the limitation of liability for incidental or consequential damages. Accordingly, some of the above limitations may not apply to you. In such cases, our liability will be limited to the fullest extent permitted by applicable law.

5Indemnification

You agree to defend, indemnify, and hold harmless Travel Smart Travel Fast, its affiliates, officers, directors, employees, agents, and licensors from and against any and all claims, damages, obligations, losses, liabilities, costs, and expenses (including but not limited to attorney's fees) arising from:

  • A. Your Use of the Service: Your use of and access to the Service, including any data or content transmitted or received by you.

  • B. Violation of Terms: Your violation of any term of these Terms, including without limitation your breach of any of the representations and warranties above.

  • C. User Responsibility for Accuracy. You are solely responsible for the accuracy, completeness, and correctness of all information and documentation submitted to us. We do not verify the accuracy of the data you provide (e.g., passport numbers, spelling of names, dates of birth). If a travel document is rejected or issued with incorrect information due to an error in the data you provided, you acknowledge that a new application and full payment of Service Fees and Government Fees will be required to correct it.

  • D. Violation of Law: Your violation of any third-party right, including without limitation any right of privacy or intellectual property rights, or your violation of any applicable law, rule, or regulation (including immigration laws).

We reserve the right to assume the exclusive defense and control of any matter otherwise subject to indemnification by you, in which event you will assist and cooperate with us in asserting any available defenses.

6Refund Policy

6.1. Incorporation of Policy. Your purchase is subject to our specific Refund Policy, which is incorporated by reference into these Terms. You may view the full policy at Refund Policy.

6.2. Key Refund Principles. By accepting these Terms, you explicitly acknowledge and agree to the following core principles of our pricing and refunds:

  • A. Non-Refundable Government Fees: Once we have paid a Government Fee to a government agency on your behalf, this portion of your payment is strictly non-refundable under any circumstances, as governments do not issue refunds.

  • B. Service Completion: Our "Service Fee" is for the professional service of reviewing, formatting, and submitting your application. Once your application has been submitted to the relevant government authority, our service is deemed fully performed and non-refundable, regardless of the government's final decision (approval or denial).

  • C. Refund Requests: All requests for refunds must be submitted directly to our support team at support@travelsmarttravelfast.com before initiating a dispute with your bank. Initiating a chargeback for a validly rendered service may result in your being permanently banned from our Service and reported to industry fraud databases.

7Dispute Resolution, Binding Arbitration & Class Action Waiver

PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS, INCLUDING YOUR RIGHT TO FILE A LAWSUIT IN COURT.

7.1. Agreement to Arbitrate. You and Travel Smart Travel Fast expressly agree that any legal claim, dispute, or controversy arising out of or relating to the Service, Content, these Terms, or any products/services sold (collectively “Disputes”), shall be resolved by CONFIDENTIAL BINDING ARBITRATION conducted before one commercial arbitrator from the American Arbitration Association (“AAA”), rather than in a court. The arbitration will be governed by the AAA's Commercial Arbitration Rules and, if applicable, the Supplementary Procedures for Consumer Related Disputes. You acknowledge that you are voluntarily forfeiting your right to a trial by jury.

7.2. Location & Fees. The arbitration shall be conducted in Bernalillo County, New Mexico, unless you and we agree otherwise. If you live more than 100 miles from this location, the arbitration may be conducted within 100 miles of your residence. Payment of all filing, administration, and arbitrator fees will be governed by the AAA Rules. We will not seek to recover attorneys’ fees from you in arbitration unless the arbitrator determines your claim is frivolous.

7.3. Exceptions (Intellectual Property & Small Claims). Notwithstanding the above, either party may: (a) Bring an individual action in Small Claims Court in Bernalillo County, New Mexico (or your local small claims court) as long as it remains an individual action; (b) Seek injunctive relief in court for disputes involving the infringement of Intellectual Property rights or misuse of the Service (e.g., hacking, scraping).

7.4. CLASS ACTION WAIVER. ALL DISPUTES MUST BE ARBITRATED ON AN INDIVIDUAL BASIS. YOU EXPRESSLY WAIVE ANY RIGHT TO PARTICIPATE IN A CLASS ACTION, COLLECTIVE ACTION, PRIVATE ATTORNEY GENERAL ACTION, OR OTHER REPRESENTATIVE PROCEEDING. The arbitrator may not consolidate more than one person’s claims.

7.5. Opt-Out Right. You may opt out of this Arbitration Agreement by notifying us in writing within 30 days of the date you first accepted these Terms. To opt out, you must send your name, address, and a clear statement that you want to opt out to:

  • Mail: Travel Smart Travel Fast LLC, 1209 Mountain Road PL NE STE R, Albuquerque, NM 87110, United States.

7.6. Pre-Arbitration Dispute Notification. Before initiating arbitration, you must give us an opportunity to resolve the Dispute. You must send a written "Notice of Dispute" to the address or email above, describing the issue and the relief sought. If we cannot resolve the Dispute within 30 days after receipt of the Notice, either party may commence arbitration.

8Payment Disputes & Chargeback Policy

8.1. Billing Descriptor. Charges on your credit card or bank statement will appear as "tstfTravelDocs" (or a similar variation depending on your card issuer). You agree to recognize this descriptor and not to report this transaction as "fraudulent" or "unrecognized" based solely on the billing name.

8.2. Mandatory Dispute Resolution First. Before initiating a chargeback or payment dispute with your bank or credit card issuer, YOU AGREE TO CONTACT US FIRST at support@travelsmarttravelfast.com to attempt to resolve the issue. Initiating a chargeback without first allowing us seven (7) business days to address your concern constitutes a material breach of these Terms.

8.3. "Friendly Fraud" Policy. We take "Friendly Fraud" (where a customer receives the Service but falsely claims the transaction was unauthorized or not received) very seriously. If you initiate a chargeback for a valid transaction, we reserve the right to:

  • A. Immediately cancel any active applications or travel authorizations. We may notify the issuing government authority of the payment fraud, which could result in the revocation of your travel document and potential denial of entry at the border.

  • B. Ban your IP address, credit card, and personal details from using our Service in the future.

  • C. Report your details to industry fraud databases, which may affect your ability to transact with other online merchants.

  • D. Dispute the chargeback by submitting full evidence to your bank, including your IP address, timestamps, email logs, and proof of service delivery.

8.4. Agreement to Reimburse. If you file a dispute that is resolved in our favor (the bank decides the charge was valid), or if we successfully reverse a chargeback, you agree to reimburse us for any administrative fees, chargeback fees, and legal costs incurred by us to fight the dispute.

9Right to Refuse Service & Termination

9.1. General Right. We reserve the right to refuse service to anyone, cancel any pending orders, and terminate your access to the Website at any time and for any reason, subject to applicable law.

9.2. Specific Grounds for Refusal. Without limiting the foregoing, we explicitly reserve the right to terminate our Service and refuse to process your application (without refund) if:

  • A. Abuse of Staff: You use abusive, threatening, harassing, or obscene language towards our customer support team or employees.

  • B. Suspicious Activity: We suspect that you are using the Service for illegal immigration, human trafficking, or fraudulent purposes, or if the documents provided appear to be forged, altered, or stolen.

  • C. Sanctions & Embargoes: You are located in, or are a national of, a country subject to U.S. Government embargoes or sanctions, or if you appear on any U.S. government list of prohibited or restricted parties (e.g., OFAC lists).

  • D. Non-Compliance: You repeatedly fail to provide the necessary information or documents required to process your application after being requested to do so.

10Privacy Policy

10.1. Privacy Policy Incorporation. By using the Service, you consent to the collection, use, and disclosure of your Personal Information as set forth in our Privacy Policy, which is incorporated herein by reference.

10.2. Authorization to Share with Governments. You clearly understand and authorize that the core purpose of our Service is to transmit your sensitive personal data (including passport details) to foreign government authorities to process your travel documentation. You acknowledge that we have no control over how these government authorities store, handle, or protect your data once we have submitted it to them. We are not liable for any data breaches, leaks, or misuse of information that occurs on government servers or systems.

10.3. International Data Transfer. You acknowledge that your information may be transferred to, stored, and processed in the United States and the destination country of your travel, where data protection laws may differ from those of your country of residence. By using the Service, you consent to this transfer.

10.4. User Device Responsibility. You are responsible for maintaining the security of the devices (computer, mobile phone) you use to access our Service. You agree to log out of your account when not using it. Travel Smart Travel Fast is not responsible for any unauthorized access to your account resulting from lost, stolen, or compromised devices, or from your use of unsecured public Wi-Fi networks.

10.5. No Guarantee of Absolute Security. While we implement industry-standard security measures (as described in our Privacy Policy), you acknowledge that no transmission of data over the Internet is guaranteed to be completely secure. You provide your Personal Information at your own risk.

11Customer Satisfaction & Issue Resolution

We strive for customer satisfaction. If you encounter an issue with your order, please contact us immediately. While we adhere strictly to our Refund Policy regarding Government Fees and completed services, we maintain the discretion to offer service credits or reprocessing assistance for clerical errors made by our team, subject to management approval. This does not constitute a waiver of our Refund Policy.

12Events Beyond Our Control (Force Majeure)

We shall not be liable for any failure to perform its obligations where such failure results from any cause beyond our reasonable control, including, without limitation, mechanical, electronic or communications failure or degradation, acts of God, pandemics, health emergencies, government actions (including border closures or changes in immigration laws), terrorism, war, or failure of third-party government websites.

13Miscellaneous

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary so that these Terms will otherwise remain in full force and effect and enforceable.
